TERMS OF THE DISTANCE SALE CONTRACT (WHOLESALE)
The present conditions concern and govern exclusively the relations of the company "KARAPANAGIOTIS KONSTANTINOS" (hereinafter: "the company"), with the persons who register at karapanagiotis-gas.gr (hereinafter "the users").
By registering at karapanagiotis-gas.gr, Users simultaneously unconditionally accept the General Terms of Use as well as this Distance Selling Agreement.
The acceptance of the present Terms and Agreements applies to every transaction with the company and the sale of goods offered through the network for the present and for the future and concerning the wholesale users. This contract is addressed exclusively to traders and commercial companies, since its subject is, as mentioned above, the wholesale sale of goods.
The company has the right to modify and renew the General Terms of Use and this contract of distance selling - wholesale at any time, unilaterally, without warning, but is obliged to notify said modifications - renewals to the wholesale users by e-mail. In the event that any user does not agree with the new terms, they have the right to request their deletion from karapanagiotis-gas.gr according to the procedure defined below (see Article 1). All terms of this distance selling agreement are deemed to be material.
ARTICLE 1
USER REGISTRATION PROCEDURE AT karapanagiotis-gas.gr
Registration on karapanagiotis-gas.gr is only allowed to natural or legal persons who have full legal capacity, have a postal address in Greece or abroad and have an e-mail address. It is also expressly forbidden to register on karapanagiotis-gas.gr to persons whose registration has been suspended and/or deleted for any reason. Each user is entitled to own only one (1) account and up to 2 accounts are allowed per IP address.
Each user expressly declares and guarantees that at the time of registration at karapanagiotis-gas.gr he provides complete, accurate and true information about his person, residential address and tax information (VAT number etc.) and that he has the required legal conditions as well as the necessary ability to understand the present terms and conditions to register at karapanagiotis-gas.gr. The company does not recognize and is not bound by any use of karapanagiotis-gas.gr by users who do not meet any of the above conditions.
Users register by completing the special electronic form available on the website with the necessary condition of filling in the mandatory fields without which it is not possible to complete the registration process. Registration is free of charge. Among other things, each user is asked to define their access information, which consists of a user name (username) and a code (password). Regarding the choice of username, the user is forbidden to choose any name that offends public honor and/or morals, or damages the rights and/or interests of third parties. The user uis obliged to keep secret the username and password he has for accessing karapanagiotis-gas.gr and not to grant and/or share them with any third parties. The user is solely responsible for the maintenance and confidentiality of his access information to karapanagiotis-gas.gr and, consequently, is solely responsible and liable for any activity, responsibility, claim, cost, and/or expense, even legal nature, connected to any use, illegal or not, of its access details.
The company reserves the right to interrupt and/or delete the user registration from karapanagiotis-gas.gr, at any time, without prior notice, if it finds any action that makes it inappropriate, problematic and/or impossible to maintain the user's registration user on karapanagiotis-gas.gr, such as, indicatively and not limited to, the fraudulent intervention in the operation of the website and/or in the awarding of the auctioned products, the provision of inaccurate personal information, the use of access information for illegal or fraudulent purposes, the breach of any of these terms and conditions and the general terms of use. ARTICLE 2

DESCRIPTION OF ORDER PROCESS

However, the company is not responsible and does not guarantee the absolute accuracy of the display of the colors of the products on the user's computer screen, as this depends on the characteristics of each screen and computer.
The network is not responsible for defects or poor quality of the products it makes available to wholesale customers. All products are received from suppliers packaged. However, in the event that a defective product or a lack of parts is proven to be found in the quantities delivered, the network informs you that the fault is the sole responsibility of our suppliers. Wholesale users reserve the right to return directly to the supplier or dealer for missing parts or product damage. The costs to the respective agent are borne by the wholesale user.
SAMPLING
Sampling is possible as soon as the product and the sample are available from the supplier. The cost of the sample shall be borne by the customer with the wholesale price quoted in the network and its transportation cost, after consultation between the customer and the network. The total cost of the sample and its transportation are discounted by the customer to the company before ordering the sample to the supplier, by depositing the amount into a bank account. The sample will be included in the delivered quantity of the customer's first order.
ARTICLE 5
LIMITATION OF LIABILITY
Under any circumstances, including in the case of negligence, the network is not responsible for any form of damage suffered by the visitor - user of the pages, services, products, options and contents of the network which he proceeds on his own initiative and with the knowledge of the terms herein and/or the wholesale distance sale agreement (on-line sale agreement) and/or the electronic payment (provided this is done directly on the network).
The products and/or services and in general the content of the network are provided "as is" without any warranty expressed or implied in any way. To the fullest extent permitted by law, the network disclaims all warranties, express or implied, including, but not limited to, those of merchantability and fitness for a particular purpose.
The Network does not warrant that the pages, products, services, options and contents will be provided without interruption, error-free and that errors will be corrected.
Also, the network does not guarantee that the same or any other related site or the "servers" through which they are made available to visitors - users, are provided without "viruses" or other harmful components.
The network does not under any circumstances guarantee the correctness, completeness or availability of the contents, pages, services, options or their results.
The cost of possible corrections or services is assumed by the visitor - wholesale user and in no case by the network.
Especially for matters related to the properties, description, use, price, etc. of the products offered for sale, visitors - wholesale users of the network must contact the network and are absolutely bound by the sales contract they are asked to conclude - they consent to the order execution process.
The network is not responsible for opinions / opinions / placements / messages / publications of third parties wherever they are expressed on the network. The network is not responsible for the content of the messages sent. Messages represent their sender and not necessarily the opinion of the people and contributors of the network or other users. ARTICLE 7
WITHDRAWAL FROM CONTRACT – PRODUCT RETURNS
Returns are accepted on products worth up to €100, except in cases of a factory defect in the product, where we undertake the service of your product and send it to you after consultation.
The above return arrangement applies only to the products that present a problem and not to the entire order. The information-consultation regarding all the above problems should be done in writing through the electronic contact platform at https://karapanagiotis-gas.gr with specific information about the return codes and quantities, as well as the method and time of their return .
Returns are accepted only if the products being returned are in the same condition in which they were received by the user, i.e. without having been unsealed or tampered with and in any case they must not have been used and their packaging must be accompanying the product (including the usual labels/tags of the product/price which must not have been removed from the product). The products must be accompanied by their relevant purchase and delivery documents (eg invoice, delivery note, receipt, bill of lading, etc.).
If the product does not meet the above conditions, the company may not accept it and therefore refuse the replacement and the product will be returned to the wholesale user at his own expense.
In any case, any damage to the product during the return of the product to the network or store, is solely borne by the wholesale user.
The network recommends that wholesale users carefully check at the time of delivery of their order the condition of the sold products and the intactness of their packaging and label in order to identify any obvious defects.
In the case of a return of the products and depending on the way the user chose to pay for his order on the one hand, and on the other the way they will be returned, the refund will be completed within 30 days from the date the network receives the products.
ARTICLE 8
PAYMENT METHODS & PRODUCT PRICES
The network, to serve wholesale users, provides them with the possibility to pay for their order in any of the following ways:
A. By charging their VISA, MASTERCARD credit card
The user's credit card is charged when the order is shipped on the date the order form is completed and submitted. The credit card that the visitor - user will use to pay for services - purchase products from the website, is charged only once and only for the specific transaction each time. The website is not responsible for the terms of use of personal data adopted by the financial institutions with which it cooperates for the completion of commercial transactions and/or for any fault thereof.
B. By bank deposit. In this case, the wholesale user must send by email to sales@karapanagiotis-gas.gr the copy of the bank deposit order in order to execute the order of the products.
The price of each wholesale product is listed in the relevant catalogs next to each product. The wholesale prices do not include VAT.
For any regions of Greece where reduced VAT rates apply, then the prices of the products are charged according to the reduced VAT. In this case, wholesale users should contact the company for the issuance of the relevant tax information.
The network prices do not necessarily represent the retail or wholesale prices of the company's store at Pyrgos Ilias, 5 Erythrou Stavrou Street.
The network company reserves the right to adjust prices without notice.
C. Refund.
ARTICLE 9
DELIVERY OF THE PRODUCTS
The wholesale user's order is delivered in two ways:
[A] no later than 5 working days from the order confirmation date (during the hours of 09:00 AM - 17:00 PM) to the transport company that the wholesale user designates in the order form taking into account relevant comments from the user wholesale for the delivery method. In this case, the network - company is not responsible in cases of delay and/or failure to deliver which is due to third-party intermediary organizations, carriers, etc. and/or for reasons ifextreme violence. The cost and risk of transporting their product is entirely borne by the wholesale user after it has been delivered by the business to the transport company. However, if for reasons of force majeure (e.g. bad weather conditions, strikes, etc.) or an insurmountable obstacle it is not possible to immediately deliver the products to the carrier designated by the wholesale user, the wholesale user is informed by e-mail, in order to state whether he still wishes, under the new conditions, to complete his order.
[B] The products can be shipped to the wholesale user anywhere within the Greek Territory, as long as there is no specific reason for inability. In this case, the products will be sent to the place indicated by the wholesale user when registering his online order, through the Hellenic Post Office or through a private transport company. The cost is borne by the wholesale user. Alternatively, the company can give the wholesale user a cost quote with the companies it cooperates with by phone or at https://karapanagiotis-gas.gr or send the product with a transport company that the wholesale user wants. Title to the product passes to the wholesale user upon full payment and risk is transferred upon delivery.
The wholesale user cannot refuse to ship the products once the network confirms availability and the wholesale user pays for the order. The delivery time depends on the place of delivery and the availability of the products.
Deliveries are made Monday to Friday after consultation and communication with the company or network.
ARTICLE 10
GOVERNING LAW & OTHER TERMS
The order forms specify any more specific terms and agreements that govern the purchase of each specific product in addition to the terms and agreements of this contract (Distance Selling Agreement - Wholesale), and the General Terms of Use.
The network reserves the right to reserve and/or refuse execution of orders if it informs the interested user - visitor of the reasons for the relevant reservation and/or refusal.
The network reserves the right to unilaterally modify the content of all terms without obligation to warn. For this reason, the visitor - user of the network must visit them often to be updated. These terms, the General Terms of Use as well as any amendment, change or alteration thereof are governed and supplemented by Greek law, European Union law and the relevant international treaties that regulate issues related to electronic commerce and distance sales. For this reason, the network must inform users about [a] the essential characteristics of the good it offers, [b] the price, [c] the quantity and transport costs, [d] the value added tax which is not included to the price as it appears on the network, [e] the method of payment, [f] the method of delivery and execution, [g] the duration of validity of the offer or price and [h] the right of withdrawal. Any provision of the above terms that becomes contrary to the law, automatically ceases to be valid and is removed from this, without in any way affecting the validity of the other terms.
